Maternity Leave Regulations Change

The Maternity and Parental Leave etc and the Paternity and Adoption Leave (Amendment) Regulations 2008 have now amended the Maternity and Parental Leave etc Regulations 1999 removing the distinction between the rights of employees on ordinary and additional maternity leave in respect of employment benefits for employees whose expected week of childbirth is on or after 5th October 2008.

The effect of this change is that employment benefits with the exception of remuneration (i.e. wages or salary) such as the accrual of contractual holidays over and above the statutory entitlement, permanent health insurance, life assurance, healthcare, cars and gym membership will continue throughout the entire period of maternity leave.
