
Compulsory Retirement Age Challenged
The retirement exemption contained within The Employment Equality (Age) Regulations 2006 has been under challenge since its inception. In the latest legal challenge by Heyday, the Advocate General on 23rd September rejected one of the case's key arguments. It did not however, settle the issue of whether or not compulsory retirement at the age of 65, as allowed by the UK's age discrimination Regulations is justified under the EU Equal Treatment Framework Directive. This opinion is not binding on the European Court of Justice, which is expected to make a final ruling later this year.
